Terms and Conditions

Please read these Terms and Conditions carefully before using the Bookends mobile application. These Terms constitute a legally binding agreement between you and Chad Holmes doing business as Bookends (“Bookends,” “we,” “us,” or “our”).

1. AGREEMENT TO TERMS

By accessing or using the Bookends mobile application (“Service”), you agree to be bound by these Terms and Conditions. You represent that you are at least 18 years old and are able to form a binding contract with Bookends. If you disagree with any part of these terms, you may not access or use our Services.

2. INTELLECTUAL PROPERTY RIGHTS

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Bookends, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service.

3. USER ACCOUNTS

When you create an account with us, you must provide accurate, complete, and current information including your email address, password, and username. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your account
  • Accepting responsibility for all activities that occur under your account

We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms.

4. PAYMENTS AND REFUNDS

The Service is currently available for a one-time payment of $9.99 through the Apple App Store. We may introduce subscription-based pricing in the future, which will be clearly communicated to users before implementation.

All payments are processed securely through the Apple App Store and are subject to Apple's payment terms and conditions. For refund requests, please contact us at andy@bookends.app. Refund eligibility will be determined on a case-by-case basis.

5. PROHIBITED USES

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To impersonate or attempt to impersonate Bookends, a Bookends employee, another user, or any other person or entity
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
  • To use any robot, spider, or other automatic device, process, or means to access the Service
  • To introduce any viruses, trojan horses, worms, logic bombs, or other harmful material

6. USER-GENERATED CONTENT

The Service may allow you to create, post, store, share, or publish content. By providing User-Generated Content, you:

  • Grant Bookends a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use any such content
  • Represent and warrant that you own or control all rights in such content
  • Agree that your content will not violate the rights of any third party
  • Understand that you are solely responsible for all content you submit

We reserve the right to remove any content that violates these Terms or that we find objectionable.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BOOKENDS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

8. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
